Terms and Conditions for the rental of the holiday apartment in Village Cap Esterel (France)
1. Scope
These Terms & Conditions apply to the rental of the privately owned holiday apartment in Village Cap Esterel (France) by the landlord to the tenant. By completing the booking the tenant acknowledges and accepts these conditions.
2. Booking and Conclusion of Contract
The booking of the apartment is made via the website, by e-mail or by telephone. The rental contract is concluded as soon as the landlord confirms the booking in writing (for example by e-mail).
3. Rental Period and Prices
The apartment is rented exclusively on a weekly basis, with a minimum rental period of 7 nights.
The weekly rates are season-dependent and are individually determined according to the requested booking period.
The rental price is bindingly communicated to the tenant in the booking confirmation.
Additional costs (e.g. water, electricity) are included in the rental price unless explicitly stated otherwise on the website.
4. Payment Terms
After booking confirmation, a deposit of 30 % of the total amount must be paid within 7 days.
The remaining balance must be paid no later than 30 days before arrival.
For bookings made within 30 days before arrival, the total amount is immediately due.
5. Security Deposit
On arrival a security deposit of € 500 is to be provided in cash. It will be refunded on the day of departure provided no damage or excessive soiling has been identified.
6. Arrival and Departure
Arrival: from 16:00 hours.
Departure: by 10:00 hours.
Deviations may be individually agreed in advance.
7. Cancellation / Withdrawal
The tenant may withdraw from the contract at any time. The following cancellation conditions apply:
Up to 60 days before arrival: 20 % of the rental price.
59 to 30 days before arrival: 50 % of the rental price.
From 29 days before arrival: 100 % of the rental price.
The conclusion of a travel cancellation insurance is strongly recommended.
8. Use of the Apartment
The apartment may be occupied by a maximum of 4 persons.
Pets are not permitted.
Smoking within the apartment is not allowed.
The tenant undertakes to treat the apartment and its furniture with care.
Any damage occurring during the rental period must be reported immediately to the landlord.
9. Use of the Village Cap Esterel Resort
The use of the facilities of the holiday resort (e.g. pool, leisure offers, internet, parking) is subject to the rules of the operator. Any applicable fees are to be borne by the tenant.
10. Liability
The landlord is not liable for temporary interruptions of electricity, water, internet or other services.
The landlord is not liable for disturbances caused by third parties (e.g. the operator of the resort).
The landlord is not liable for loss or damage to the tenant’s belongings.
The tenant is liable for all damage caused by them, their companions or their visitors to the rental property or its furniture.
11. Data Protection
The personal data of the tenant are used solely for the processing of the booking and for fulfilling legal obligations. Further information is provided in the privacy policy on this website.
12. Applicable Law and Jurisdiction
The law of the French Republic applies, unless mandatory consumer protection regulations of the country in which the tenant has their habitual residence override it. The place of jurisdiction is the landlord’s place of residence, insofar as permitted by law.
Note: This holiday apartment is privately rented. It does not constitute a commercial rental activity.
